CHA health — Terms of Service

1. Acceptance of Terms
By accessing or using the CHA health platform at app.mycha.health (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.
The Service is operated by CHA health (“CHA,” “we,” “us,” or “our”). These Terms apply to all visitors, users, and others who access or use the Service, whether via a registered account or the anonymous bill audit flow.
2. Description of Service
CHA health is a medical bill audit platform. You upload a medical bill, and our system analyzes it for potential billing errors, overcharges, and coding issues. The Service provides informational audit findings only — it does not constitute medical, legal, or financial advice, and it does not guarantee any particular outcome with your healthcare provider or insurer.
CHA health is available through both (a) an anonymous bill audit flow that does not require an account, and (b) a registered account experience with additional features such as audit history, dispute letter generation, and billing management.
3. User Accounts
To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
We support multi-factor authentication (MFA) to help secure your account. You are encouraged to enable MFA. You agree to notify us immediately at matt@mycha.health if you suspect any unauthorized use of your account.
You must be at least 18 years of age to create an account or use the Service.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload bills or documents that you do not have the legal right to submit for audit (e.g., bills belonging to another person without their authorization).
- Attempt to gain unauthorized access to other users' accounts, data, or any part of the Service infrastructure.
- Interfere with or disrupt the integrity or performance of the Service, including through automated means (bots, scrapers, or similar tools) without our prior written consent.
- Reverse-engineer, decompile, or disassemble any part of the Service except as permitted by applicable law.
- Use the Service to transmit malware, viruses, or any other harmful code.
We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Terms.
5. Protected Health Information (PHI) and HIPAA
CHA health is a HIPAA-covered entity. When you upload a medical bill, you may be providing protected health information (“PHI”) as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).
We handle your PHI in accordance with our Privacy Policy, which describes our data collection, de-identification, use, and retention practices. By using the Service, you authorize CHA to receive, process, and store your PHI for the purpose of performing the bill audit you request.
For anonymous bill audits, your PHI is de-identified under the HIPAA Safe Harbor standard at 45 CFR section 164.514(b)(2) after processing. See our Privacy Policy for details on our de-identification commitments and your rights.
We maintain administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of your PHI, including encryption at rest (AES-256) and in transit (TLS 1.3), access controls, and audit logging.
6. Billing and Refunds
CHA health offers a free tier that includes up to three (3) bill audits at no charge. Additional audits and premium features are available through paid plans. Pricing details are available on our Pricing page.
Payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you agree to Stripe's Terms of Service. CHA does not directly store your full credit card number.
If you are unsatisfied with an audit result, you may contact us at matt@mycha.health within thirty (30) days of the audit to request a refund. Refund requests will be evaluated on a case-by-case basis. Free-tier audits are not eligible for refunds.
7. Intellectual Property
The Service, including its software, algorithms, user interface, branding, and all related content, is the property of CHA health and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
You retain ownership of the medical bills and documents you upload. By uploading content, you grant CHA a limited, non-exclusive license to process that content for the purpose of providing the Service. For anonymous audits, you additionally authorize CHA to retain de-identified data as described in our Privacy Policy.
8. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CHA health does not guarantee the accuracy, completeness, or reliability of any audit finding. Audit results are informational and are not a substitute for professional medical billing review, legal advice, or financial counseling.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHA HEALTH AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF CHA HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL CHA HEALTH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID CHA HEALTH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
9. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles.
Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution in the state or federal courts located in the State of California. You consent to the personal jurisdiction of such courts.
Nothing in this section limits your right to file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights regarding HIPAA matters, or with any other applicable regulatory body.
10. Changes to Terms
We may revise these Terms at any time by updating this page. Material changes will be communicated through the Service (e.g., a banner or email notification to registered users) at least fifteen (15) days before they take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
We encourage you to review these Terms periodically. The “Last updated” date at the top of this page indicates when the most recent changes were published.
